Asbestos notification

Before demolition or substantial renovation of an older building, most jurisdictions require documentation about asbestos-containing materials. Depending on the building and the scope, that is either a survey by a licensed asbestos consultant or a signed affidavit stating that no asbestos-containing material will be disturbed.

Where it applies in the lifecycle

Obtained during Preparation, since a survey takes time and sampling, and filed at Submission as part of the application package. It is frequently a hard gate: departments that require it will not accept a demolition application without it.

Why it is separate from the building code

The underlying requirement is federal environmental law, administered through state and local agencies, rather than the building code. That is why the notification often goes to a different agency than the permit, on a different form, with its own waiting period. Building on the assumption that the permit covers it is a common way to lose two weeks.

Practical points

• Age thresholds vary, but buildings from before the early 1980s are the usual trigger
• The notification typically has a waiting period, often ten working days, before demolition may start
• The renovation threshold is lower than people expect; disturbing a modest quantity of suspect material can trigger it
• Penalties for skipping it are environmental penalties, which are considerably heavier than building code ones
